Terms of Service – Staart Buildtech

Welcome to Staart Buildtech Private Limited (“Staart”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, services, software-enabled project management tools, consultancy, procurement coordination, advisory, and related services.

By accessing our website, submitting an enquiry, communicating with us, or using our services, you agree to these Terms. If you do not agree, please do not use our website or services.

1. About Staart

Staart provides software-enabled project management consultancy, procurement coordination, project advisory, documentation support, and execution monitoring services for interior and construction projects.

Our services may include, depending on the agreed scope:

  • Project planning and coordination

  • BOQ review and cost tracking

  • Procurement support and vendor coordination

  • Timeline and progress monitoring

  • Site reporting and documentation

  • Billing, quality, and execution tracking

  • Software-enabled dashboards, reports, and project information systems

  • Advisory support for clients, owners, project teams, vendors, and contractors

The exact scope of service will be defined in the proposal, quotation, work order, agreement, or other written communication shared with the client.

2. Use of Our Website and Services

You agree to use our website and services only for lawful and legitimate business purposes.

You agree not to:

  • Misuse our website, tools, forms, or communication channels

  • Submit false, misleading, or incomplete information

  • Attempt to access systems, data, or project information without authorization

  • Copy, reproduce, or misuse our content, reports, templates, software, or intellectual property

  • Upload harmful files, malware, spam, or unlawful content

  • Interfere with the security, performance, or operation of our website or systems

  • Use our services for fraudulent, illegal, or unauthorized purposes

We reserve the right to restrict or discontinue access if we believe there is misuse, unauthorized activity, or violation of these Terms.

3. Client Responsibilities

Clients are responsible for providing accurate and timely information required for project evaluation, planning, coordination, and service delivery.

This may include:

  • Project requirements

  • Drawings and layouts

  • BOQs and specifications

  • Site information

  • Budget and timeline expectations

  • Vendor, contractor, consultant, or stakeholder details

  • Approvals, decisions, and clarifications required for progress

Staart is not responsible for delays, errors, cost impact, or project issues caused by incomplete information, delayed approvals, third-party delays, site conditions, or changes in client requirements.

4. Project Scope and Deliverables

The scope, deliverables, fees, timelines, payment terms, and responsibilities for each project will be defined separately through a proposal, quotation, agreement, work order, purchase order, or written confirmation.

Any additional work, change in scope, urgent requirement, rework, or additional coordination beyond the agreed scope may be charged separately.

Staart may provide advisory, coordination, reporting, procurement support, and project management assistance. Unless specifically agreed in writing, Staart does not act as the legal owner, principal contractor, statutory consultant, or guarantor of any third-party work.

5. Procurement and Vendor Coordination

Where procurement coordination is included in the scope, Staart may assist with vendor identification, quotation collection, comparison, negotiation support, documentation, and coordination.

Clients understand and agree that:

  • Final vendor selection and purchase approval remain with the client unless otherwise agreed

  • Vendor pricing, delivery timelines, warranties, and performance are subject to vendor terms

  • Staart may coordinate with vendors, suppliers, consultants, contractors, and service providers for project execution

  • Staart is not responsible for third-party delays, defects, warranty failures, price changes, or non-performance unless specifically agreed in writing

6. Fees, Payments, and Taxes

Fees and payment terms will be communicated through a proposal, quotation, invoice, agreement, or written confirmation.

Unless stated otherwise:

  • Fees are payable as per agreed payment milestones

  • Applicable taxes, including GST, will be charged as per law

  • Payments once made are generally non-refundable except where specifically agreed in writing

  • Delay in payment may result in delay, suspension, or discontinuation of services

  • Any additional work outside the agreed scope may be billed separately

7. Refund and Cancellation Policy

Refunds, cancellations, or service termination requests will be reviewed on a case-by-case basis, depending on the nature of service, stage of work completed, expenses incurred, and contractual terms agreed with the client.

For consultancy, advisory, project planning, documentation, reporting, procurement coordination, or project management work already performed, fees may not be refundable.

Any approved refund will be processed as per mutually agreed terms and applicable law.

8. Software-Enabled Tools and Dashboards

Staart may use internal or client-facing digital tools, dashboards, reports, forms, communication systems, or software-enabled workflows to support project management, procurement, documentation, and reporting.

Access to any such tools may be provided only for the agreed project or service duration. Users must not share login credentials, misuse project data, or attempt unauthorized access.

Staart may update, improve, restrict, suspend, or discontinue software features or access as required for security, maintenance, business, or operational reasons.

9. Intellectual Property

All website content, software tools, dashboards, reports, templates, documents, designs, processes, methods, text, graphics, brand names, logos, and other materials created or owned by Staart are the intellectual property of Staart or its licensors.

You may not copy, reproduce, distribute, modify, sell, reverse engineer, or commercially exploit any Staart material without written permission.

Client-provided documents, drawings, and project information remain the property of the client or respective owners. Staart may use such information only for providing agreed services, internal records, compliance, and project-related purposes.

10. Confidentiality

Both Staart and the client may exchange confidential project, commercial, technical, financial, vendor, or business information.

Each party agrees to take reasonable steps to protect confidential information and not disclose it to unauthorized third parties, except where required for service delivery, legal compliance, or with consent.

Staart may share necessary project information with employees, consultants, vendors, suppliers, contractors, technology providers, or service partners involved in the project.

11. Limitation of Liability

Staart will make reasonable efforts to provide services professionally and responsibly. However, to the maximum extent permitted by law, Staart shall not be liable for:

  • Indirect, incidental, special, or consequential losses

  • Loss of profit, revenue, business opportunity, or goodwill

  • Delays caused by clients, vendors, contractors, consultants, authorities, or site conditions

  • Third-party defects, delays, pricing changes, warranty issues, or service failures

  • Errors caused by incorrect, incomplete, or delayed information provided by the client or third parties

  • Events beyond our reasonable control

Our total liability, if any, shall be limited to the amount paid by the client to Staart for the specific service giving rise to the claim, unless otherwise agreed in writing.

12. No Guarantee of Project Outcome

Staart provides project management consultancy, advisory, coordination, reporting, and software-enabled support. While we aim to improve transparency, cost control, quality tracking, and timeline visibility, we do not guarantee any specific project outcome, cost saving, completion date, vendor performance, or approval unless expressly agreed in writing.

13. Privacy and Data Protection

Your use of our website and services is also governed by our Privacy Policy, which explains how we collect, use, store, share, and protect your information.

By using our website or services, you agree to the practices described in our Privacy Policy.

14. Third-Party Services and Links

Our website or services may contain links to third-party websites, tools, platforms, payment systems, analytics services, or vendor resources.

We are not responsible for the content, privacy policies, terms, availability, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.

15. Suspension or Termination of Services

We may suspend or terminate access to services, software tools, dashboards, or project support if:

  • Payment is delayed or not made

  • Required information or approvals are not provided

  • There is misuse of our website, systems, tools, or project information

  • There is breach of these Terms or agreed contractual terms

  • Continuing the service becomes commercially, legally, technically, or operationally impractical

Termination does not affect payment obligations for services already provided or costs already incurred.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, technology, or business practices.

The updated version will be posted on this page with a revised effective date. Continued use of our website or services after updates means you accept the revised Terms.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising out of or relating to these Terms, our website, or our services shall be subject to the courts of Hyderabad, Telangana, India, unless otherwise agreed in writing.
